AIG, investment banks fall as Wall Street reels
And then there were two: nervous investors awoke Monday to the shocking news that Lehman Brothers, a 158-year-old investment bank, had filed for Chapter 11 bankruptcy protection. That same morning, another storied bank fell victim to the deepening financial crisis as Merrill Lynch was purchased by Bank of America. Their failures left only two independent investment banks on Wall Street: Goldman Sachs and Morgan Stanley.

Goldsmith, Feldman, and Notre Dame Dean debate separation of powers
Widely considered one of the most ambiguous areas of legal scholarship, the separation of powers often comes to the fore at times of divided government and international conflict. Three renowned legal scholars discussed and debated current separation of powers issues before a nearly-full Ames Courtroom on Sept. 9. The event was the first in a series of panels sponsored by the Federalist Society. Professor Noah Feldman, Professor Jack L. Goldsmith, and William K. Kelley, the Assistant Dean and Associate Professor of Law at Notre Dame Law School treated audience members to a lively discussion.

American Greed
The events that have shaken the financial world were the culmination of an all too common refrain in America's market-exuberance: fueled by obscene greed, followed by a sobering crash which leaves the taxpayers holding the bag for those who grasped at the Golden Ring one too many times. One would think that we would have learned our lesson from history.

Speaking to a standing-room-only audience in the Ames Courtroom during her State of the School Speech on Monday, September 16, Dean Elena Kagan remarked that Supreme Court Justice Louis Brandeis' enthusiasm about HLS' future had been born out today, as the school again worked to reshape legal education. Touching on five areas - faculty appointments, public service, curricular reform, campus improvements, and technology - she outlined the school's achievements over the last year as well as its goals for the next.

Early on the morning of Saturday, September 13th, Hurricane Ike, a roaring behemoth of a storm, swept off the Gulf of Mexico, blasting the island of Galveston, Texas with a wall of sea water. As the eye of the storm passed overhead, residents who had been warned of "certain death" ventured into the streets to survey their battered community and seek high ground.

Refugees in South Africa: Living in Fear, Grateful for Help
After seeing reports in the US media of xenophobic violence in South Africa prior to my departure for Cape Town, I was originally concerned about my safety. However, as I soon discovered, xenophobia in South Africa means only a dislike of other black Africans, not white legal interns from America. Instead, the violence was directed at people from other African nations, primarily the DRC, Somalia, and Zimbabwe, who fled to South Africa to escape violence and/or poor economic situations in their home countries.

Talking Peace – A Postcard from the Far East
Can this really mean peace? This question swirled in my head as I looked at the draft agreement in my hands. For the past thirty or so years, Filipino Muslim separatists have waged an armed rebellion against the Philippine government. Was it really possible that after seven years of negotiations with the main rebel group, the Moro Islamic Liberation Front (MILF), peace was no more than a signature away?

Work/Life Overload
Conventional wisdom has it that first-year law students can only talk about the law, and new parents can only talk about their children. Try being a 1L and becoming a parent in the same year. For the past six months all I've been able to talk about is how my son Andrew is unconstitutional neither facially nor as applied, and how Mass G.L. c. 234A,

Fenno Sells Out
As he shut the phone on his former boss, Fenno had an epiphany. Maybe life wasn't about being smugly satisfied with one's righteous - yet strictly nine-to-five - work on behalf of the less fortunate. Maybe, life had more to do with that dreaded list of estates in property, the order of the Federal Rules of Civil Procedure, or even, god help him, Bluebooking.
