HLS Must Give Clinical Instructors a Fair Contract. Our Education Depends on It.

Photo by Kelsey Carido / The Harvard Law Record.

*Editor’s Note: Earlier today, more than 50 Harvard Law School students staged a sit-in in Langdell Library, calling on HLS to agree to the clinical instructor union’s bargaining demands. Students studied quietly, wore buttons reading “Students Support HLS Clinicians,” and taped signs of support to their laptops. The following open letter, currently signed by 265 HLS students participating in clinics and student practice organizations, urges the HLS administration to agree to the union’s bargaining demands.

To the Editor:

We are a group of Harvard Law School students writing to urge Harvard Law School to agree to the clinical instructor union’s bargaining demands, including compensating them appropriately, respecting their contributions to HLS and its students, and supporting their autonomy as educators. All of the undersigned students participate in clinics and student practice organizations, which are a core part of our Harvard Law experience.

Many of us chose HLS over other law schools in large part because of the clinical programs available here. That decision was not just about the breadth of opportunities to receive hands-on legal experience – it was also about the quality of that clinical instruction. We firmly believe that HLS is home to some of the best clinical instructors in the country, and we urge the university to treat them as such.

Every year, HLS celebrates students who have chosen to go into public interest careers and make a positive impact on our communities immediately after graduation. But for many of us, it would be impossible to enter those fields without all that we have learned from our clinical instructors. Our clinical instructors are the only people at HLS who provide the tangible legal instruction required for us to be considered competitive candidates for most public interest positions. As law students, we are disappointed that the HLS administration is eager to publicly tout our public interest achievements while failing to back that praise with competitive salaries for the clinical instructors who make those achievements possible.

In the last year, we have felt the morale in our clinics drop as the negotiations with HLS drag on, signaling to some of our favorite and most effective teachers that they are not respected and valued members of the HLS community. We have felt the strain on our instructors’ time as they juggle lengthy and demanding union negotiations alongside their teaching commitments. We have even witnessed some of our favorite instructors leave Harvard rather than continue to be under-compensated. Harvard Law School’s public celebration of clinical legal work during high-profile events from recruiting and admissions all the way through commencement stands in stark contrast with its refusal to provide competitive compensation. This contradiction has not gone unnoticed and is deeply insulting to both the instructors and to us, as students invested in practicing the law long-term.

It is critical to our learning that Harvard Law School agrees to the clinical instructors’ demands before we lose more instructors, waste more time, and further compromise our legal education.
